December 22, 2020 FDA Issues Warnings to Companies Selling CBD Products
“The warning letters include CBD products that are especially concerning from a public health perspective due to the route of administration, including nasal, ophthalmic and inhalation. In addition, they address violations relating to the addition of CBD to food, and the impermissible marketing of CBD products as dietary supplements. Two of the letters also address CBD products illegally marketed for pets, including a product for use in the eye.”

Drug Enforcement Administration Interim Rule effective August 21, 2020
Federal Register Volume 85, Number 163 (Friday, August 21, 2020)
Issue: Hemp is decontrolled meaning removed from the Controlled Substances Act pursuant to the Agriculture Improvement Act (AIA) of 2018. DEA thus is clearly stating their regulatory authority is removed over any plant with less than 0.3% THC on a dry weight basis.
However, the DEA states in the Interim Rule “the definition of hemp does not automatically exempt any product derived from a hemp plant, regardless of the Δ9-THC content of the derivative. In order to meet the definition of “hemp,” and thus qualify for the exemption from schedule I, the derivative must not exceed the 0.3% Δ9-THC limit.”
Hemp Advocates are concerned because the 0.3% THC number is arbitrary and across the country we have been advocating for a 1% to 5% THC level for hemp plants. Processors are concerned. Public Comments are open until October 20, 2020. https://beta.regulations.gov/document/DEA-2020-0023-0001
